Terms of Service

Sparkle operates a marketplace for homeowners and independent cleaners. These Terms explain the rules that apply when you browse Sparkle, create an account, apply as a cleaner, book services, send messages, use Sparkle’s payment flows, or otherwise interact with the platform.

1. Acceptance and Eligibility

These Terms of Service govern your use of the Sparkle website, account system, booking tools, cleaner application flow, messaging features, and related platform services. By accessing or using Sparkle, you agree to be bound by these Terms.

You may use Sparkle only if you can form a binding agreement and provide accurate, current, and complete information. You are responsible for keeping your login credentials secure and for activity that occurs through your account.

2. Sparkle’s Role

Sparkle is a technology marketplace that helps homeowners connect with independent cleaning professionals. Sparkle does not itself perform cleaning services and, for cleaners, Sparkle is not an employer, staffing agency, or joint employer.

Homeowners book services through the platform, and approved cleaners decide whether to participate under the separate Sparkle independent contractor and payout terms that apply to cleaner accounts.

3. Accounts, Applications, and Platform Access

Sparkle may allow homeowners to register accounts directly and may allow cleaners to apply for review before gaining access to cleaner features. Sparkle may approve, reject, suspend, limit, or terminate access at its discretion to protect users, comply with law, or enforce platform standards.

If you provide false information, attempt to create unauthorized accounts, misuse another person’s account, or bypass onboarding, verification, or payment requirements, Sparkle may restrict or end your access.

4. Homeowner Bookings

Homeowners are responsible for submitting accurate booking details, including address, timing, service type, notes, and payment information required to complete checkout. Booking requests and availability are subject to cleaner acceptance, platform rules, and operational review.

Homeowners must use the platform lawfully, communicate honestly, and not misuse promo codes, payment flows, reschedule requests, disputes, or support tools.

5. Payments, Cancellations, Refunds, and Disputes

Sparkle uses third-party payment providers, including Stripe, to process charges, refunds, and related payment activity. By placing a booking, you authorize Sparkle and its payment providers to process the transaction and any related adjustments permitted by these Terms or required to resolve operational issues, disputes, or fraud.

Based on Sparkle’s current platform logic, pending bookings and cleaner no-show reports may qualify for a full refund. Confirmed bookings cancelled more than 24 hours before the scheduled cleaning may also qualify for a full refund. If a homeowner cancels within 24 hours of the scheduled cleaning, Sparkle may deny a refund and may still schedule the cleaner’s payout under the platform’s payout rules.

Sparkle may review reported issues, mark bookings as disputed, pause or hold payouts, issue full or partial refunds, deny refund requests, or otherwise adjust booking records when needed to investigate service problems, payment disputes, cancellations, no-shows, safety concerns, or policy violations.

6. Cleaner Participation

Cleaners who are approved to use Sparkle’s cleaner tools may be required to complete additional onboarding, identity verification, insurance review, contractor agreement acceptance, and payout policy acknowledgment before going live.

Cleaner participation on Sparkle is also governed by separate cleaner-facing agreements and policies, including Sparkle’s Independent Contractor Agreement and payout policy. If those terms conflict with these general Terms for a cleaner’s work on the platform, the cleaner-specific terms control for that topic.

7. Payouts and Stripe Services for Cleaners

Sparkle currently uses Stripe Connect to support cleaner payout onboarding and payout release. Completed paid bookings are generally placed into a review hold before payout release, and the current platform logic uses a 72-hour review window for many completed bookings. Payouts may remain on hold longer for disputes, chargebacks, compliance review, incomplete Stripe setup, or manual admin review.

Payment processing services for cleaners on Sparkle are provided by Stripe and are subject to the Stripe Connected Account Agreement and the Stripe Services Agreement. By using Sparkle as a cleaner where Stripe services apply, you agree to provide accurate information needed for payout services and authorize Sparkle to share required account and transaction information with Stripe.

8. Messages, Reviews, and User Content

Sparkle may allow users to send messages, submit reviews, provide booking notes, upload profile media, and contact support. You remain responsible for the content you submit and agree not to post unlawful, abusive, misleading, defamatory, infringing, or spam content.

Sparkle may remove or restrict content, reviews, messages, profile materials, or uploaded documents if Sparkle believes they violate these Terms, create legal risk, or conflict with platform standards, safety, or operational needs.

9. Prohibited Conduct

You may not:

  • use Sparkle for unlawful, fraudulent, abusive, or deceptive activity;
  • impersonate another person or misrepresent your identity, role, eligibility, or qualifications;
  • attempt to access non-public parts of the platform or interfere with platform security or operations;
  • scrape, copy, reverse engineer, or exploit the platform outside permitted use;
  • use Sparkle to avoid applicable fees, payment rules, review processes, or platform restrictions.

10. Third-Party Services

Sparkle relies on third-party providers for important parts of the service, including hosting, authentication, storage, email delivery, and payment processing. Sparkle is not responsible for outages, delays, or policy changes caused by those third-party services, although Sparkle may take operational steps in response.

11. Suspension, Termination, and Changes

Sparkle may modify, pause, or discontinue platform features, service areas, booking tools, promotions, payout timing, fees, or operational policies at any time. Sparkle may also suspend or terminate any account or booking access where needed to investigate misconduct, protect users, manage legal or payment risk, or enforce these Terms.

You may stop using Sparkle at any time, but ending use of the platform does not erase obligations tied to prior bookings, payment disputes, refunds, chargebacks, investigations, or other matters that arose while you were using the service.

12. Disclaimers and Limitation of Liability

To the maximum extent permitted by law, Sparkle provides the platform on an "as is" and "as available" basis and does not guarantee uninterrupted access, error-free operation, cleaner availability, specific booking outcomes, or any minimum level of earnings, business volume, or customer demand.

To the maximum extent permitted by law, Sparkle will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, loss of data, or reputational harm arising out of or related to your use of the platform. Sparkle’s total liability for claims arising out of these Terms will not exceed the amounts paid to Sparkle by you, or paid by Sparkle to you, through the platform during the three months before the event giving rise to the claim.

13. Governing Law and Contact

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except where applicable law requires otherwise.
